1. Introduction

CloudClasses is an online tutoring platform that connects tutors with students and their parents or guardians. By registering for an account or using our platform, you agree to be bound by these Terms & Conditions. Please read them carefully before using the service. If you do not agree to these terms, you should not use CloudClasses.

You must be at least 18 years old to create an account on CloudClasses. Students under 18 must be invited by, and thereafter represented by a parent or legal guardian who gives consent for them to receive tuition. CloudClasses is not responsible for any dispute regarding parental consent.

2. Deferred Payment

When you book a session through CloudClasses, your payment card is saved securely via Stripe but you are not charged at the time of booking. Your card will only be charged 48 hours after the tutor marks the session as completed. This gives you time to raise any concerns before payment is taken.

By proceeding to checkout, you authorise CloudClasses to charge the saved payment method for the agreed session price after the session has been completed and the resolution window has closed.

3. Multi-Session Bookings

You may book multiple sessions with the same tutor in a single checkout. When you do so, your card is saved once but each session is charged separately after it has been completed. For example, if you book 5 sessions, you will see 5 individual charges on your card over time as each session takes place and is marked complete by the tutor.

The 48-hour resolution window (see below) applies to each session individually. You may raise a concern about any specific session without affecting the others. Similarly, cancelling one session from a multi-session booking does not affect the remaining sessions.

4. Resolution Window

After a session is marked as completed by the tutor, a 48-hour resolution window begins. During this window:

  • You may contact CloudClasses support to raise any issues with the session.
  • If a valid concern is raised, CloudClasses may cancel or adjust the payment before it is processed.
  • Once the 48-hour window closes, the charge is processed automatically and is non-refundable except in exceptional circumstances at CloudClasses' discretion.

5. Cancellation Policy

Sessions may be cancelled by any participant (tutor, parent, or student) subject to the following rules:

Tutor cancellations

If the tutor cancels a session at any time, the parent will not be charged. The session is removed from the calendar and the tutor's time slot becomes available for rebooking.

Parent or student cancellations

  • 24 hours or more before the session: The session is cancelled free of charge. No payment is taken.
  • Less than 24 hours before the session: The full session fee is charged immediately as a late cancellation fee. This compensates the tutor for the reserved time.

After a session has started

Sessions cannot be cancelled more than 10 minutes after the scheduled start time. If you need to end a session early, please contact the tutor directly or reach out to support.

6. Payment Failures

If the deferred charge fails (for example, due to insufficient funds or an expired card), CloudClasses will retry the charge up to 3 times over the following days. If all attempts fail, you will be notified by email and asked to update your payment method. Outstanding balances remain payable.

7. Refunds

Refunds are handled on a case-by-case basis. If you believe you have been charged in error or the session did not meet reasonable expectations, please contact CloudClasses support within 7 days of the charge. Refund requests submitted after 7 days may not be honoured.

8. Tutor Payouts

Tutors receive their share of the session fee after a successful charge, minus the platform fee. Payouts are processed on the tutor's chosen schedule (weekly every Friday, or monthly on the last Friday of the month). CloudClasses retains a platform fee (currently 20%) from each session.

Payment processing services are provided by Stripe Payments Europe, Ltd ("Stripe") and are subject to the Stripe Connected Account Agreement and Stripe Services Agreement. By operating as a tutor on CloudClasses, the tutor agrees to be bound by the Stripe Terms as may be amended by Stripe from time to time, and authorises CloudClasses to share relevant information and transaction data with Stripe.

9. User Responsibilities

All users are responsible for maintaining the security of their account credentials and must notify CloudClasses immediately if they believe their password has been compromised. Users are responsible for all activity conducted under their account until they have notified us.

Users must not post defamatory, offensive, or illegal material on the platform. Users must ensure that all personal details and contact information are accurate and up to date. Users are responsible for ensuring they have the correct equipment and internet connection to participate in online sessions.

10. Intellectual Property

By uploading content (including files, images, and materials) to CloudClasses, you grant CloudClasses a non-exclusive, royalty-free licence to store, display, and distribute that content as necessary to provide the service. You retain ownership of your content and may remove it at any time.

You must not upload content that infringes the intellectual property rights of any third party, contains viruses or malicious code, or is otherwise unlawful.

11. Platform Disclaimer

CloudClasses provides a platform to connect tutors with students and their families. Tutors are self-employed contractors, not employees of CloudClasses. While we undertake checks including DBS verification during onboarding, CloudClasses is not responsible for the quality, content, or outcome of any tutoring session. Parents and students are responsible for assessing the suitability of any tutor they choose to book with.

CloudClasses will endeavour to maintain the platform and keep it available, but cannot guarantee uninterrupted access. Occasional downtime for maintenance may occur.

12. Limitation of Liability

Nothing in these terms limits or excludes CloudClasses' liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot be excluded or limited by law.

Subject to the above, CloudClasses' total liability arising out of or in connection with the use of the platform shall not exceed the greater of £100 or the total fees paid by the user in the 12 months preceding the event giving rise to the claim. CloudClasses shall not be liable for any indirect, incidental, or consequential losses, including loss of profit, data, or goodwill.

13. Data and Privacy

Payment information is handled securely by Stripe. CloudClasses does not store full card numbers. By using our service, you consent to Stripe's processing of your payment data in accordance with their privacy policy. 14. Governing Law & Jurisdiction

These terms and conditions and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising from these terms.

15. Severability

If any provision of these terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

CloudClasses reserves the right to update these terms at any time. Material changes will be communicated via email to registered users at least 14 days before they take effect. Continued use of the platform after changes constitutes acceptance of the updated terms.
